Amendments to the fixed penalty provisions in the London Local Authorities (LLA) Act 2004

Fixed Penalties for Environmental Offences

London Councils' Transport and Environment Committee (TEC) at its meeting of 13 December 2007 agreed the discount amounts introduced by amendments to the London Local Authorities Act 2004. Fixed penalty notices under this Act now have a 28 day payment period and a 14 day discount period. The discount amounts for the fixed penalties already agreed are as set out in the attached table in appendix 1. This decision has immediate effect. Borough officers to use.

Fixed Penalty Notices

Section 68 of the London Local Authorities (LLA) Act 2007 amends the LLA Act 2004's fixed penalty provisions by introducing a longer notice period for fixed penalty notices (FPNs) - from 14 days to 28 days, and introducing a period i.e. 14 days, during which a discount amount of fixed penalty must apply. The Transport and Environment Committee (TEC) has now agreed the "specified proportion" by which the full fixed penalty will be reduced if paid within the discount period of 14 days.

The attached table in appendix 1 sets out the agreed discount amounts for the offences for which fixed penalty amounts had been previously set by the Transport and Environment Committee. These decisions take effect immediately.
