Item 12 - London Local Authorities Act 2007

 

Summary:

 

This report updates on progress made towards implementing sections 23 and 24 of the London Local Authorities Act (LLAA) 2007, which will give London boroughs powers to issue penalty charge notices for:

  • Contravention of regulations relating to receptacles for waste (section 23); and
  • Littering from vehicles (section 24)

It is anticipated that boroughs will be able to use and enforce these powers from 18 June 2012.

Members’ views are sought on the penalty charge levels, previously approved by TEC in June 2009.  This report also seeks member agreement to proposals for the unit charge to be applied to each appeal received, and makes members aware of a good practice guide developed to support boroughs. 

Recommendations:

Members are recommended to

  • Note that sections 23 and 24 of the LLAA 2007 should be enforceable from 18 June 2012.
    • Review the current level of penalty charge for the LLAA 2007, s.23, set by TEC on 9 June 2009 at £110; and
    • Comment on whether the level of penalty charge should remain at £110 or be reduced to £80 to ensure consistency with the EPA 1990.
    • Review the current level of penalty charge for the LLAA 2007, s.24, set by TEC on 9 June 2009 at £100; and
    • Comment on whether the level of penalty charge should remain at £100 or be reduced to £80 to ensure consistency with the EPA 1990.
    • Agree the unit charge to the enforcing authority for each appeal received to be £45 for the remainder of 2012/13.
