Abandoned vehicles

The Act:

  • amends previous legislation so that in some circumstances councils will no longer have to give notice to occupiers that they intend to remove abandoned vehicles from their land, saving time and money

  • tightens existing legislation so that anyone wishing to reclaim a vehicle that has been removed by the council will need to produce evidence that he or she has paid the fixed penalty for the offence, and has the necessary insurance, tax and MOT certificate (if the owner does not have the documents he or she can pay a bond to take away the vehicle, which will be repaid when the documents are produced. Enforcement cannot begin until the level of the bond has been agreed, likely to be by June 2008)
